Who says the state of Montana don't have guts? Sure it only applys to guns made in the state but it is the things said within the legislation that are important.

Montana Governor Signs New Gun Law Executive Summary - The USA state of Montana has signed into power a revolutionary gun law. I mean REVOLUTIONARY. The State of Montana has defied the federal government and their gun laws. This will prompt a showdown between the federal government and the State of Montana . The federal government fears citizens owning guns. They try to curtail what types of guns they can own. The gun control laws all have one common goal - confiscation of privately owned firearms.

Montana has gone beyond drawing a line in the sand. They have challenged the Federal Government. The fed now either takes them on and risks them saying the federal agents have no right to violate their state gun laws and arrest the federal agents that try to enforce the federal firearms acts. This will be a world-class event to watch. Montana could go to voting for secession from the union, which is really throwing the gauntlet in Obama's face. If the federal government does nothing they lose face. Gotta love it.

Important Points - If guns and ammunition are manufactured inside the State of Montana for sale and use inside that state then the federal firearms laws have no applicability since the federal government only has the power to control commerce across state lines. Montana has the law on their side. Since when did the USA start following their own laws especially the constitution of the USA , the very document that empowers the USA .

Silencers made in Montana and sol in Montana would be fully legal and not registered. As a note silencers were first used before the 007 movies as a device to enable one to hunt without disturbing neighbors and scaring game. They were also useful as devices to control noise when practicing so as to not disturb the neighbors. Silencers work best with a bolt-action rifle. There is a long barrel and the chamber is closed tight so as to direct all the gases though the silencer at the tip of the barrel. Semi-auto pistols and revolvers do not really muffle the sound very well except on the silver screen. The revolvers bleed gas out with the sound all over the place. The semi-auto pistols bleed the gases out when the slide recoils back. Silencers are maybe nice for snipers picking off enemy soldiers even though they reduce velocity but not very practical for hit men shooting pistols in crowded places. Silencers were useful tools for gun enthusiasts and hunters.

There would be no firearm registration, serial numbers, criminal records check, waiting periods or paperwork required. So in a short period of time there would be millions and millions of unregistered untraceable guns in Montana . Way to go Montana !

Discussion - Let us see what Obama does. If he hits Montana hard they will probably vote to secede from the USA . The governor of Texas has already been refusing Federal money because he does not want to agree to the conditions that go with it and he has been saying secession is a right they have as sort of a threat.. Things are no longer the same with the USA . Do not be deceived by Obama acting as if all is the same, it is not. Text of the New Law HOUSE BILL NO. 246 .

Section 1. Short title. [Sections 1 through 6] may be cited as the "Montana Firearms Freedom Act".Section 2. Legislative declarations of authority. The legislature declares that the authority for [sections 1 through 6] is the following:

(1) The 10th amendment to the United States constitution guarantees to the states and their people all powers not granted to the federal government elsewhere in the constitution and reserves to the state and people of Montana certain powers as they were understood at the time that Montana was admitted to statehood in 1889. The guaranty of those powers is a matter of contract between the state and people of Montana and the United States as of the time that the compact with the United States was agreed upon and adopted by Montana and the United States in 1889.

(2) The ninth amendment to the United States constitution guarantees to the people rights not granted in the constitution and reserves to the people of Montana certain rights, as they were understood at the time that Montana was admitted to statehood in 1889. The guaranty of those rights is a matter of contract between the state and people of Montana and the United States as of the time that the compact with the United States was agreed upon and adopted by Montana and the United States in 1889.

(3) The regulation of intrastate commerce is vested in the states under the 9th and 10th amendments to the United States constitution, particularly if not expressly preempted by federal law. Congress has not expressly preempted state regulation of intrastate commerce pertaining to the manufacture on an intrastate basis of firearms, firearms accessories, and ammunition.

(4) The second amendment to the United States constitution reserves to the people the right to keep and bear arms as that right was understood at the time that Montana was admitted to statehood in 1889, and the guaranty of the right is a matter of contract between the state and people of Montana and the United States as of the time that the compact with the United States was agreed upon and adopted by Montana and the United States in 1889.

(5) Article II, section 12, of the Montana constitution clearly secures to Montana citizens, and prohibits government interference with, the right of individual Montana citizens to keep and bear arms. This constitutional protection is unchanged from the 1889 Montana constitution, which was approved by congress and the people of Montana , and the right exists, as it was understood at the time that the compact with the United States was agreed upon and adopted by Montana and the United States in 1889.

Section 3. Definitions. As used in [sections 1 through 6], the following definitions apply:

(1) "Borders of Montana " means the boundaries of Montana described in Article I, section 1, of the 1889 Montana constitution.

(2) "Firearms accessories" means items that are used in conjunction with or mounted upon a firearm but are not essential to the basic function of a firearm, including but not limited to telescopic or laser sights, magazines, flash or sound suppressors, folding or aftermarket stocks and grips, speedloaders, ammunition carriers, and lights for target illumination.

(3) "Generic and insignificant parts" includes but is not limited to springs, screws, nuts, and pins.

(4) "Manufactured" means that a firearm, a firearm accessory, or ammunition has been created from basic materials for functional usefulness, including but not limited to forging, casting, machining, or other processes for working materials.

Section 4. Prohibitions. A personal firearm, a firearm accessory, or ammunition that is manufactured commercially or privately in Montana and that remains within the borders of Montana is not subject to federal law or federal regulation, including registration, under the authority of congress to regulate interstate commerce. It is declared by the legislature that those items have not traveled in interstate commerce. This section applies to a firearm, a firearm accessory, or ammunition that is manufactured in Montana from basic materials and that can be manufactured without the inclusion of any significant parts imported from another state. Generic and insignificant parts that have other manufacturing or consumer product applications are not firearms, firearms accessories, or ammunition, and their importation into Montana and incorporation into a firearm, a firearm accessory, or ammunition manufactured in Montana does not subject the firearm, firearm accessory, or ammunition to federal regulation. It is declared by the legislature that basic materials, such as unmachined steel and unshaped wood, are not firearms, firearms accessories, or ammunition and are not subject to congressional authority to regulate firearms, firearms accessories, and ammunition under interstate commerce as if they were actually firearms, firearms accessories, or ammunition. The authority of congress to regulate interstate commerce in basic materials does not include authority to regulate firearms, firearms accessories, and ammunition made in Montana from those materials. Firearms accessories that are imported into Montana from another state and that are subject to federal regulation as being in interstate commerce do not subject a firearm to federal regulation under interstate commerce because they are attached to or used in conjunction with a firearm in Montana ...

Section 5. Exceptions. [Section 4] does not apply to:

(1) A firearm that cannot be carried and used by one person;

(2) A firearm that has a bore diameter greater than 1 1/2 inches and that uses smokeless powder, not black powder, as a propellant;

(3) ammunition with a projectile that explodes using an explosion of chemical energy after the projectile leaves the firearm; or

(4) a firearm that discharges two or more projectiles with one activation of the trigger or other firing device.

Section 6. Marketing of firearms. A firearm manufactured or sold in Montana under [sections 1 through 6] must have the words "Made in Montana " clearly stamped on a central metallic part, such as the receiver or frame.

Section 7. Codification instruction. [Sections 1 through 6] are intended to be codified as an integral part of Title 30, and the provisions of Title 30 apply to [sections 1 through 6].

Section 8. Applicability. [This act] applies to firearms, firearms accessories, and ammunition that are manufactured, as defined in [section 3], and retained in Montana after October 1, 2009.

WASHINGTON — Anyone, said T.S. Eliot, could carve a goose, were it not for the bones. And anyone could govern as boldly as his or her whims decreed, were it not for the skeletal structure that keeps civil society civil - the of rule of law. The Obama administration is bold. It also is careless regarding constitutional values and is acquiring a tincture of lawlessness.

In February, California's Democratic-controlled Legislature, faced with a $42 billion budget deficit, trimmed $74 million (1.4 percent) from one of the state's fastest growing programs, which provides care for low-income and incapacitated elderly and cost the state $5.42 billion last year. The Los Angeles Times reports that "loose oversight and bureaucratic inertia have allowed fraud to fester."

But the Service Employees International Union collects nearly $5 million a month from 223,000 caregivers who are members. And the Obama administration has told California that unless the $74 million in cuts are rescinded, it will deny the state $6.8 billion in stimulus money.

Such a federal ukase to a state legislature is a sign of the administration's dependency agenda - maximizing the number of people and institutions dependent on the federal government. For the first time, neither sales nor property nor income taxes are the largest source of money for state and local governments. The federal government is.

The SEIU says the cuts violate contracts negotiated with counties. California officials say the state required the contracts to contain clauses allowing pay to be reduced if state funding is.

Anyway, the Obama administration, judging by its cavalier disregard of contracts between Chrysler and some of the lenders it sought money from, thinks contracts are written on water. The administration proposes that Chrysler's secured creditors get 28 cents per dollar on the $7 billion owed to them, but that the United Auto Workers union get 43 cents per dollar on its $11 billion in claims - and 55 percent of the company. This, even though the secured creditors' contracts supposedly guaranteed them better standing than the union.

The Economist says the administration has "ridden roughshod over (creditors') legitimate claims over the (automobile companies') assets."

This is not gross, unambiguous lawlessness of the Nixonian sort - burglaries, abuse of the IRS and FBI, etc. - but it is uncomfortably close to an abuse of power that perhaps gave Nixon ideas: When in 1962 the steel industry raised prices, President Kennedy had a tantrum and his administration leaked rumors that the IRS would conduct audits of steel executives, and sent FBI agents on predawn visits to the homes of journalists who covered the steel industry.
The Obama administration's central activity - the political allocation of wealth and opportunity - is not merely susceptible to corruption, it is corruption.

I had an Epiphany

Hello,

I study International Relations ( Specifically: TERRORISM and COUNTER TERRORISM ) when I'm studying at a University, on a Graduate Level. This is why I post notes here for you.

Epiphany: Today, Americans hear about ENHANCED Interogation Techniques, which oh by the way, We train our own troops on ( GIVING and RECEIVING ). The recent contraversy is about concern that the release of certain CLASSIFIED PICTURES will cause Allied Troops to be in further jeopardy !?! You mean more so than the CLASSIFIED DOCUMENTS that have already been EXPOSED this Year, DID?

What part of : Hostages of Terrorists, Military Prisoners of Terrorists and Government Officials, not to forget the attrocities against innocent Civilian Men, Women and Children of the effected Countries, perpetrated by these TERRORISTS, have all been DECAPITATED, blown up, and KILLED or MAIMED in numerous ways already; did these Promonent Individuals who are trying to SABOTAGE American and Allied efforts to thwart these TERRORISTS, by RELEASING THE CLASSIFIED DOCUMENTS in the first place, fail to acknowlege or UNDERSTAND?!?

How could it be worse than it already is?

TERRRORIST is the wrong NOUN and ADJEC TIVE. They are MURDERERS, ANARCHISTS, RAPISTS, EXTREMISTS, KIDNAPPERS, THIEVES, BANDITS, MERCENARIES WITHOUT A COUNTRY, ARSONISTS, SERIAL KILLERS, NON UNIFORMED INSURGENTS and- TYRANTS and more...; to properly name a few appropriate NOUNS and ADJECTIVES !

Frankly, the partial or total release of Classified Documents to the Public and thus to our ENEMIES too, is not guarenteed by the CONSTITUTION, the benchmark for all law in the United States of America. The. release of CLASSIFIED DOCUMENTS puts the American and thier Allie's Military, in greater Harms Way, along with US too! We used to understand this, as is illustrated by an old adage from WWII " Loose Lips Sink Ships ! "

WASHINGTON — From Oct. 18 to Dec. 3, 1961, 116,000 people visited New York's Museum of Modern Art before anyone noticed that Henri Matisse's painting "Le Bateau" had been hung upside down. Modernity is supposed to "transgress" standards of the traditional, which is why Paul Hindemith, while rehearsing one of his dissonant orchestral compositions, said to the musicians, "No, no, gentlemen - even though it sounds wrong, it's still not right."

Proponents of today's world-turned-upside-down economic policies say the policies might seem wrong but really are boldly modern in their rejection of markets in favor of pervasive government intervention in economic life. Hence New York, which until eight months ago was the financial capital of the world, is no longer even the financial capital of the United States.

Washington is.

So says Ian Bremmer in "State Capitalism Comes of Age: The End of the Free Market?" in the current issue of Foreign Affairs. It should be read by Americans who are dismayed by the blurring of the line between public and private sectors.

Most Americans assume - and are encouraged to do so by those doing the blurring - that the government is doing this reluctantly and is eager to find an "exit strategy" to "unwind" its interventions. Bremmer, president of the consulting firm Eurasia Group, believes that although the governments of many developing nations have made "a strategic rejection of free-market doctrine," governments of developed countries do not intend to "manage" their economies "indefinitely." About the former, he is correct. About the latter, his wish may be the father of his thought.

Among the myriad signs that many nations are developing systems "in which the state functions as the leading economic actor," Bremmer notes that the 13 largest oil companies are owned and operated by governments and that governments in the developing world control three-quarters of the world's energy reserves. Privately owned multinational companies produce just 10 percent of the world's oil and own just 3 percent of its proven reserves. In many developing nations, large companies that remain in private hands are only nominally private: They are government appendages in that they are dependent on government patronage for credit, contracts and subsidies. "Sovereign wealth funds" already account for one-eighth of global investment. .

In Democracy in America, Alexis de Tocqueville anticipated people being governed by "an immense, tutelary power" taking "sole charge of assuring their enjoyment and of watching over their fate." Tocqueville said, "It does not break wills; it softens them, bends them, and directs them" until people resemble "a herd of timid and industrious animals, of which the government is the shepherd."

So what today seems as modern as Matisse once seemed was actually foreseen 17 decades ago. Like Hindemith's music, what is happening seems wrong. And it is.

Experience what the ordinary, moral German felt in the mid-1930s

I thought I would never be able to experience what the ordinary, moral German felt in the mid-1930s. In those times, the savior was a former smooth-talking rabble-rouser from the streets, about whom the average German knew next to nothing. He edged his way onto the political stage through great oratory and promises.

Economic times were tough, people were losing jobs, and he was a great speaker. And he smiled and waved a lot. And people, even newspapers, were afraid to speak out for fear that his "brown shirts" would bully them into submission.

And then he was duly elected to office, with a full-throttled economic crisis at hand. Slowly but surely, he seized the controls of government power, department by department, person by person, bureaucracy by bureaucracy.

How did he get the people on his side? He did it by promising jobs to the jobless, money to the moneyless and goodies for the military-industrial complex. He did it by indoctrinating the children, advocating gun control, health care for all, better wages, better jobs, and promising to re-instill pride once again in the country, across Europe, and across the world.

He did it with a compliant media. And he did this all in the name of justice and change.

Germany was the most educated, cultured country in Europe. And in less than six years, it was rounding up its own citizens, killing others, abrogating its laws, turning children against parents and neighbors against neighbors. All with the best of intentions, of course. The road to Hell is paved with them!

General George Washington went back to Philadelphia from 1781 to 1782, exhorting Congress to maintain its exertions for liberty, and to settle the army's claims for pay. Canada Free Press managing editor Judi McLeod writes No cheerleader for propping up greenback at G20 summit asking, “Is the table being set for One World Government rather than speeding the recovery of the worldwide recession at next week’s20G20 London summit?” Obamanation has taken the nation from a trillion in debt to over $4 trillion in debt in the first sixty days, with even more federal spending promised, which could put the nation $10 trillion in debt before the 2010 mid-term election cycle. Amnesty for illegals and ACORN led redistricting will make 2010 and beyond a moot point. Still, beyond the movement to mail tea bags to members of congress or file another legal demand for proof of Obama’s constitutional eligibility for the office he holds, both of which are like whistling in the breeze, the people remain largely silent. Threatened with a Soup Line Existence, the American people would never trade personal freedom for the false promise of federally redistributed free-stuff under some ill-fated socialist experiment, unless they were first threatened with a soup line existence.

And so it shall be… 50% of their life savings and 30% of their home values have already evaporated into thin air. National unemployment is driving towards double digits as home foreclosures continue to mount. Wi th their backs against the wall, confused by a daily diet of media manipulated headlines aimed at scaring the public into submission, convinced that our nation’s complex woes demand a solution far too complicated for the average peasant to comprehend, the people find themselves in a state of terminal paralysis.

Incompetent Evil in Charge
The same people responsible for the many disasters now surrounding every American household, were elected in 2006 and 2008 to fix what they broke. Instead of reversing course and placing their faith in the principles of freedom, they are installing more of the same failed entitlement policies that created the problem and they are doing so at a fever pace. The folks currently in charge of the nation don’t like anything at all about the nation that once was. They have a very different vision for America , one based on redistribution of free-stuff, not equal access to freedom. At the foundation of pers onal freedom is the right to make your own decisions, invest and risk your own capital, own your own property and keep that which you are willing to work and sacrifice to earn. It’s called economic freedom, aka capitalism. But capitalism is public enemy #1 in America today, thanks to decades of class warfare and the art of division via social envy, all for purpose of political gain.

Life, Liberty and the right to individually define and pursue Happiness has been replaced with the right of some to take from others against their will, in the name of a greater common good, better defined as the entitlement mentality.

The Change Agents New World Dictionary
Old concepts have been redefined. Capitalism is now referred to as Fascism. Personal ambition is now called greed. Those who seek access to other people’s rightful earnings are called charitable, and those who demand a right to only that, which they earn, are called greedy. It isn’t just the words that have new definitions. The concepts have new meaning as a result. Words like socialism and communism no longer have a negative connotation attached to them. Most Americans have no idea what they are anymore, or why they don’t want to find out the hard way. The concept of liberal interpretations limits the meaning of words only to one’s individual imagination. The Constitution means only what someone imagines it to mean. If the shoe doesn’t quite fit, a new definition will solve the problem.

What are Americans Waiting For?
I don’t know what it will take to wake up the average American, but whatever it is, it hasn’t happened yet… The people currently stocking up on food, water, guns and ammo in record numbers, causing shortages in all the above at the retail level, are clearly awake and anticipating something, but what? Meet the “extremists...” The people still trying to get a court somewhere in America to hear the arguments concerning the most secretive corrupt president in US history, have been awake for a long time. Meet the “birthers...” But they continue to have trouble waking anyone else up, including in the so-called halls of justice. Is it a bankrupt dollar and a new international currency that will get their attention? – A North American Union ? - An ACORN army on their doorstep? What will be the final straw that breaks the proverbial camel’s back? I don’t have the answer… Frankly, I expected the people to revolt long before now. Clearly, I had underestimated the depth of apathy and tolerance for anti-American nonsense in the average modern American. But then, so did our nation’s founders, whom I’m certain are rolling over in their graves in disgust by now.

The Silent Consent Continues
Nobody knows for how long or at what expense, but so far, the people remain silent and Washington continues to profitably interpret that silence as broad-based consent. At this late date, I have no idea what will wake up the average American or how they might react once finally awake and ready to engage in self-governance. However, I am sure about two things… When they finally do awake, they are going to be really angry… And, the anti-American left won’t let up until then…

The clock isn’t just ticking.
Time has already run out as of the 2008 election.& nbsp; Washington DC is currently dismantling America , individual right by individual right, in an unprecedented massive multi-faceted assault on all things American. If you are not familiar with the Democratic Socialists of America or their legislative branch, the Congressional Progressive Caucus, I strongly suggest that you take time to learn them well. They are in charge of your nation. This is who the average American is up against and they are a very well funded and organized enemy of the state.

You will not be able to take your country back without putting these two organizations out of business. The longer you wait, the tougher the battle, the higher the price. Clearly, the organizational skills of the average American are equal only to that o f the stumbling bumbling Republican Party. Fragmented, distracted and disorganized, the people are no match for the leftist juggernaut running roughshod in DC. The people are lost, so the y are losing… The most complex problems require the simplest of solutions. But the average American is so baffled by a daily diet of elitist B.S., that they cannot even see daylight…

When all else fails, return to the basics!

It worries me. I am aware that the Educational System here in the United States is slanted to a particular, and not necessarily open and honest direction. In the military we call this DisInformation and Propoganda ( no I'm not talking about you ).

I have a habit ( good or bad ) of Political Passion; which is part of my personality; it got me into Graduate School, and for me it is inescapable.

Soon, my credentials will be posted on my site. I have travelled far and in Military Service,

USAF-LE-ABGD. I had a long Tour Overseas, and I am Honorably Discharged. I have lived and travelled abroad. I have lived with and experienced our Allie's ways of Life, and that of Our ENEMIE'S.

Among other things, I am certified ABGD ( Air Base Ground Defence ). This is NOT training to guard a fence or vital resource alone. We are trained to Exterminate with Extreme Prejudice in the Battle Field, those enemies of the United States Constitution, both Foreign and Domestic.

Tyrants do not Negotiate, unless they believe they will win on their terms, with their enemys complete Capitulation. To stay in Power, they cannot suffer any threats, to their Political, Industrial, Economic and Military Power Bases to exist. Freeedom is not something Tyrants can

Yes, the advent of the internet aided in the Fall of the Soviet Union, through communications ( communications between Russian commmunities, which stopped the Proletariat from covering up Tyranical treatment of their felllow Russians ) however, that was only after The Western Allies had Bankrupted the Soviet Union, after 50 Years of The Cold War, and Arms / Technology Races. Again, Millions died anyway ( Vietneam, Korean War, The Russian invasion of Afganistan, and all the other proxy wars supported by Tyrants, all over the world. During that 50 Years of treatys and Conversations aka Negotiations. Our Governments, Russia and The US, went beyond the point of Launching Nuclear Weapons every day of that 50 Years. Mutually Assured Destruction aka MAD. Thankfully, there was a Red Phone direct link from The US to Moscow. Why did these enemies not push the Button? Because the Russians LOVE their Children, and Backed Off due to The Strength of The American and their Allie's Military. Otherwise, we'd all be speaking Russian, NOW. Example: research The Bay pf Pigs Invasion of Cuba and the Russian Nuclear Wepons disposition there, at that time. While you are at it, research the Russian Military presence in Venezuela today.

During the Iran / Iraq war, Iran sent Thousands of Teen Aged Children, in Battalions, UNARMED into the Battle Field. These thousands of Teen Aged Children, in Battalions were instructioned to march against fortified Iraqi Army positions, to be Slaughtered. Survivors of the Child Battalion's were ordered to pick up discarded Iraqi Weapons, and use those Weapons on the retreating Iraqis. Do you think the Iranian Government loves their Children; or are they slaves to JIHAD?

These Dictators and Tyrants will not be kind to us, or our Children, if they win Conventionally in WAR. The Iranian Government would fire/deploy Nuclear or Biological Weapons against The United States, if they had them. They would do this even if the Iranian Government knew for certain that an American Counter Strike of Nuclear Weapons would TOTALLY Destroy Iran. Notice, I did not say the Iranian People aka subjects of the Government, I said The Iranian Government aka Despots and Tyrants. Even we needed the French help overthrow the Brittish Yoke !

Democracy in other Contries is NOT what you might think.

Research the proxy wars currently being fought in the Middle East, South East Asia and Africa today. Tyrants and Despots. Would you want that here?

The people overseen by Tyrants and Dictators are uneducated, poor and in some cases starving, for a reason. Example: only the privileged and wealthy are aforded perks like travel and education in Totalitarian Regimes. Tyrants and Dictators cannot suffer an Educated and wealthy Middle Class, as this would threaten their Power Base.

Let no one fool you! As long as there are Tyrants and Dictators, Freedom and Freedom Loving Citizens are at WAR and UNDERSEIGE. And, unfortunately, it is a fight to the Death. Winner take ALL !

There is one way to communicate "Peacefully" with Tyrants and Dictators: Capitulation and Servitude. I for one will not do either.

To survive in a hostile environment, and that is the world we live in, one must be willing and able to defend against Tyrants and Despots. The alternative is Capitulation and Servitude, or Death.

Every Soldier in the American Military wants Peace; but not at the expense of Capitulation and Servitude, or Death for anyone.

(PS) - Regarding Torture and any advanced Interrogation: The United States did not, in the 1970's during the Vietnam Era, sign the adjustment to the Geneva Conventions pertaining to Guerilla/Terrorist War Civilian Fighters. The treatment of Terrorists engaged in Terrorist Warfare are not protected by the Geneva Conventions, from The US Military, in Terrorist engagements. Look it up, I did !

Defrauding Our SOCIAL SECURITY Fund ?

The Geneva Convention of 22 August 1864 was the world's first multilateral humanitarian treaty. Sixteen nations were present, responding to public concern about the sufferings of sick and wounded soldiers, well publicized by the labors of Florence Nightingale in the Crimean War, Clara Barton and the U.S. Sanitary Commission in the American Civil War, and the dramatic book The Memory of Solferino (1862) by Henry Dunant, a Swiss, about the casualties at the Battle of Solferino in 1859. Dunant and four other Genevan philanthropists had already launched, in October 1863, what would become the international Red Cross movement. Now the twelve initial signatories bound their armies to respect and protect the lives and workplaces of each other's ambulance and medical personnel; to incorporate volunteer auxiliaries into their medical corps; and to signify their virtual neutrality by a protective emblem, "a red cross on a white ground." The United States acceded to the convention in 1882.Its consequences were mixed. The popularity of national Red Cross societies actually facilitated social mobilization for war purposes. On the other hand, the convention set a valuable humanitarian precedent, of which the most obvious sequels were its successively extended versions of 1906, 1929, 1949, and 1977.

The first multilateral humanitarian treaty, established in Geneva August 22, 1864. It included provisions to protect all establishments and personnel that treated wounded soldiers, incorporate volunteers into the medical corps, and establish the Red Cross symbol as a sign of neutrality. Subsequent Geneva conventions were established in 1906 and 1929 to extend the provisions and concepts of the first. Another Geneva convention was approved on August 12, 1949, after World War II in response to the need to codify the nature of war crimes. They included torture and other inhumane treatment as violations of the laws of war and extended provisions from previous conventions. On June 8, 1977, two protocols to the 1949 conventions were approved to protect civilians from becoming objects of attack, extend protection to guerrilla combatants, and establish commissions to investigate violations of international law. Over 150 nations have approved the 1949 conventions, and approximately half that number have approved those of 1977. The United States has not approved the latter. The Hague Conventions also established similar treaties.

Series of four international agreements (1864, 1906, 1929, 1949) signed in Geneva, Switz., that established the humanitarian principles by which the signatory countries are to treat an enemy's military and civilian nationals in wartime. The first convention was initiated by
Jean-Henri Dunant; it established that medical facilities were not to be war targets, that hospitals should treat all wounded impartially, that civilians aiding the wounded should be protected, and that the Red Cross symbol should serve to identify those covered by the agreement. The second convention amended and extended the first. The third stated that prisoners of war should be treated humanely and that prison camps should be open to inspection by neutral countries. The 1949 conventions made further provisions for civilians falling into a belligerent's hands. Guerrilla combatants were extended protection in two 1977 amendments, which the U.S. did not sign. Violations of the Geneva Conventions were among the crimes included in the jurisdictions of the international criminal tribunals for the former Yugoslavia (1993) and Rwanda (1994) and the International Criminal Court (2002). Geneva Conventions, a series of international agreements drafted for the amelioration (improvement)of the treatment of the sick and wounded, in particular—but all prisoners—in land and sea warfare. The first Geneva Convention (1864)covered field armies only. Subsequent conventions extended that coverage to include the sick and wounded at sea, the treatment of prisoners of war, and the protection of noncombatants during time of war. The principles first articulated in the Geneva Conventions have become the cornerstones of international laws regulating conduct in wartime.
The first agreement resulted from the outcry that followed the publication in 1862 of Un Souvenir de Solferino, by Jean Henri Dunant, a cofounder of the Red Cross. His book—describing the suffering of wounded French, Italian, and Austrian soldiers in northern Italy in 1859 because of inadequate medical facilities—resulted in the convocation of an unofficial congress at Geneva in 1863 and, in the following year, of the formal sessions whose convention was ratified by the United States, most other American countries, and twelve European nations. An 1868 convention, while not ratified, expanded the earlier agreement to include naval warfare. The articles of the two conventions were observed during the Franco-Prussian (1870–1871)and Spanish-American (1898)wars.

Another conference was held in 1906 at Geneva, at which the conventions were revised; these were adopted by the Hague Peace Conference of 1907. The brutality of World War I demonstrated the need for clearer international guidelines in regard to what constituted lawful and unlawful conduct in wartime. In 1929, the conventions—signed by forty-seven nations—were widened to include provisions to improve the lot of prisoners of war. On the eastern front of the European theater, as well as in the Pacific, both the Axis and Allied powers routinely violated the protocols of the Geneva Conventions. Nazi Germany, in particular, murdered huge numbers of Soviet prisoners of war. The war crimes committed by the Nazis, coupled with their perpetration of the Holocaust, constituted the major charges levied the German government leaders during the 1946 Nuremberg Tribunal. The latest Geneva Convention—in 1949—was ratified by sixty-one countries, including the United States. Its four articles covered the amelioration of conditions of the wounded and sick in the armed forces, including those in the field and those shipwrecked at sea (articles I and II); the treatment of prisoners of war (III); and, in response to Nazi atrocities in World War II, the treatment and legal status of noncombatants in wartime (IV). The subjects of the last two articles, issues in World War II, were raised also during the Vietnam War. Since the latter was partially a guerrilla war, the distinction between armed combatants in civilian dress and noncombatants was blurred, and the applicability of the conventions to the Vietnam conflict was questioned. The United States and South Vietnam both publicly adhered to the convention, unlike North Vietnam and the National Liberation Front, which were also unwilling to allow the International Red Cross to inspect their prisoner-of-war camps.

Geneva Conventions, series of treaties signed (1864–1949) in Geneva, Switzerland, providing for humane treatment of combatants and civilians in wartime. The first convention, signed by 16 nations, covered the protection of sick and wounded soldiers and medical personnel and facilities, and was instrumental in the development of the International Committee of the Red Cross. Later conventions extended (1906) the first to naval warfare and covered (1929) the treatment of prisoners of war. As a result of World War II, particularly of the conduct of Germany and Japan, four conventions were adopted in 1949 to strengthen and codify earlier treaties and safeguard civilians.

A set of international rules that govern the treatment of prisoners, the sick and wounded, and civilians during war. Under the Geneva Conventions, for example, ambulances and military hospitals and their staff are officially neutral and are not to be fired upon. Nearly all countries of the world have agreed to the Geneva Conventions.

The Geneva Conventions consist of four treaties formulated in Geneva, Switzerland, that set the standards for international law for humanitarian concerns. These four treaties are the bases for humanitarian law across the world.
They chiefly concern the treatment of non-combatants and prisoners of war. They do not affect the use of weapons in war, which are covered by the Hague Conventions of 1899 and 1907 and the Geneva Protocol on the use of gas and biological weapons of 1925 (The 1951 Convention Relating to the Status of Refugees is also referred to as "the Geneva Convention", but it is not part of these four).
The Conventions were the results of efforts by Henri Dunant, who was motivated by the horrors of war he witnessed at the Battle of Solferino in 1859. In 1977 and 2005 three separate amendments were made part of the Geneva Conventions.
The adoption of the First Convention followed the foundation of the International Committee of the Red Cross in 1863. The text is given the title Resolutions of the Geneva International Conference, Geneva, 26–29 October 1863.
As of 2 August 2006, when the Republic of Montenegro adopted the four conventions, they have been ratified by 194 countries.[1]
All conventions were revised and expanded in 1948.
First Geneva Convention "for the Amelioration of the Condition of the Wounded and Sick in Armed Forces in the Field" (first adopted in 1864, last revision in 1949).
Second Geneva Convention "for the Amelioration of the Condition of Wounded, Sick and Shipwrecked Members of Armed Forces at Sea" (first adopted in 1906).
Third Geneva Convention "relative to the Treatment of Prisoners of War" (first adopted in 1929, last revision in 1949).
Fourth Geneva Convention "relative to the Protection of Civilian Persons in Time of War" (first adopted in 1949, based on parts of the 1907 Hague Convention IV).

Protocols
In addition, there are three additional amendment protocols to the Geneva Conventions:
Protocol I (1977): Protocol Additional to the Geneva Conventions of 12 August 1949, relating to the Protection of Victims of International Armed Conflicts. As of 12 January 2007, it had been ratified by 167 countries.
Protocol II (1977): Protocol Additional to the Geneva Conventions of 12 August 1949, relating to the Protection of Victims of Non-International Armed Conflicts. As of 12 January 2007, it had been ratified by 163 countries.
Protocol III (2005): Protocol Additional to the Geneva Conventions of 12 August 1949, relating to the Adoption of an Additional Distinctive Emblem. As of June 2007, it had been ratified by 17 countries and signed but not yet ratified by an additional 68 countries (see Red Crystal).

Revision and ratification
All four conventions were last revised and ratified in 1949, based on previous revisions and partly on some of the 1907 Hague Conventions; the whole set is referred to as the "Geneva Conventions of 1949" or simply the "Geneva Conventions". Later conferences have added provisions prohibiting certain methods of warfare and addressing issues of civil wars. Nearly all 200 countries of the world are "signatory" nations, in that they have ratified these conventions.
Clara Barton was instrumental in campaigning for the ratification of the First Geneva Convention by the United States; the U.S. signed in 1882. By the Fourth Geneva Convention, some 47 nations had ratified the agreements.

General Provisions of the First Three Common Articles
Each of the four conventions begins with three virtually identical articles.

Common Article 1
Article 1 reads: "The High Contracting Parties undertake to respect and to ensure respect for the present Convention in all circumstances."

Common Article 2
Article 2 specifies which parties are bound, and under what circumstances.
That any armed conflict between two or more "High Contracting Parties" is covered;
That it applies to occupations of a "High Contracting Party";
That the relationship between the "High Contracting Parties" and a non-signatory, the party will remain bound until the non-signatory no longer acts under the strictures of the convention. "...Although one of the Powers in conflict may not be a party to the present Convention, the Powers who are parties thereto shall remain bound by it in their mutual relations. They shall furthermore be bound by the Convention in relation to the said Power, if the latter accepts and applies the provisions thereof."

Common Article 3
Article 3 has been called a "Convention in miniature." It is the only article of the Geneva Conventions that applies in
non-international conflicts.[2]
It describes minimal protections which must be adhered to by all individuals within a signatory's territory during an armed conflict not of an international character (regardless of citizenship or lack thereof): Noncombatants, combatants who have laid down their arms, and combatants who are hors de combat (out of the fight) due to wounds, detention, or any other cause shall in all circumstances be treated humanely, including prohibition of outrages upon personal dignity, in particular humiliating and degrading treatment. The passing of sentences must also be pronounced by a regularly constituted court, affording all the judicial guarantees which are recognized as indispensable by civilized peoples. Article 3's protections exist even though no one is classified as a prisoner of war.
The article text for Article 3 of the Second Geneva Convention differs from the other three Conventions in that it adds "shipwrecked" to the "wounded and sick."
Article 3 also states that parties to the internal conflict should endeavour to bring into force, by means of special agreements, all or part of the other provisions of the Geneva Conventions.
